1. Definitions

  • "Boriphat" / "we" / "us" / "our" — the legal services practice registered and operating in Khon Kaen, Thailand.
  • "User" / "you" / "your" — any person who accesses this website or engages our services.
  • "Services" — the pension legal support services offered by Boriphat, as described on this website.
  • "Agreement" — the contract formed between Boriphat and a client when a service engagement is confirmed in writing.
  • "Website" — the website accessible at https://boriphat.world and its associated pages.

2. Acceptance of Terms

By using this website or contacting us to enquire about or engage our services, you agree to be bound by these Terms and Conditions. These terms apply to all users of this website and to all clients who retain our services. If you do not agree, please do not use this website or our services. Our services are available only to persons aged 18 and over who have legal capacity to enter into binding agreements under Thai law.

3. Service Description

Boriphat provides three legal support services in connection with pension matters in Thailand: Pension Eligibility Review (฿1,900), Documentation & Records Preparation (฿5,750), and Representation Before Pension Authorities (฿3,500). Services are delivered in Khon Kaen and, where applicable, through remote consultation. We do not provide general legal advice outside of pension and social security matters.

4. Website Use

This website is provided for informational purposes only. No material on this site constitutes formal legal advice for your specific circumstances. You agree not to use this website for any unlawful purpose, to attempt to gain unauthorised access to any part of the site, or to interfere with its operation.

5. User Responsibilities

When engaging our services, you agree to provide accurate, complete, and up-to-date information. You are responsible for the accuracy of any documents or records you supply to us.

You agree not to knowingly provide false information, to withhold material facts relevant to your case, or to use our services for any unlawful purpose.

6. Intellectual Property

Written case reports and documents we produce for you as part of a service engagement are provided for your personal use and for use with the relevant pension authorities only.

7. Payment Terms

Service fees are payable in Thai Baht (THB). The applicable fee for each service is confirmed in writing before work commences. Payment is due upon confirmation of engagement unless otherwise agreed in writing.

We accept payment by bank transfer to a Thai bank account or by cash at our office. Payment details are provided at the time of engagement.

If work is not started due to circumstances within our control, fees already paid will be returned in full. If work is begun and then cancelled at your request, fees already paid may be retained in proportion to work completed, at our reasonable discretion.

8. Service Delivery Terms

The scope of each service is defined in writing at the outset. Any additional work required beyond the agreed scope will be discussed with you before it proceeds, and additional fees (if any) will be confirmed in advance.

We will provide realistic timelines for each engagement but cannot commit to fixed completion dates where those dates depend on actions by third parties such as pension authorities.

All case-related information you provide to us will be treated with professional confidentiality in accordance with our Privacy Policy and the obligations of the Lawyers Council of Thailand.

9. Disclaimers

Information provided through this website is for general informational purposes only and does not constitute legal advice tailored to your personal situation. Boriphat makes no representation about the outcome of any particular case. Results of legal proceedings before pension authorities depend on many factors outside our control. We provide competent, careful professional support but do not promise specific outcomes.

10. Limitation of Liability

To the extent permitted by Thai law, Boriphat's liability to you in connection with any service engagement is limited to the amount of fees paid for that specific service. We are not liable for indirect, consequential, or incidental loss. Nothing in these Terms excludes liability for fraud or wilful misconduct.

11. Indemnification

You agree to indemnify Boriphat against any claims, losses, or expenses arising from your breach of these Terms or from the provision of false or misleading information in connection with our services.

12. Termination

Either party may terminate a service engagement by giving written notice. Upon termination, you will pay for work completed to the date of termination. We may also terminate an engagement if you provide materially false information or breach these Terms in a way that cannot be remedied.

13. Dispute Resolution

These Terms are governed by the laws of Thailand. Any dispute arising in connection with our services will first be addressed through direct communication. If unresolved within 30 days, disputes may be referred to the courts of Khon Kaen Province, Thailand, which shall have exclusive jurisdiction.

14. General Provisions

These Terms constitute the entire agreement between you and Boriphat with respect to your use of this website and our services, superseding any prior discussions.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to exercise any right does not constitute a waiver of that right. You may not assign your rights under any service agreement without our prior written consent.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised date. For active service engagements, we will notify you of any material changes. Continued use of our website after any update constitutes acceptance of the revised Terms.
